Drawing Dates: Registration for the Drawing begins at 12:01:00 a.m. Eastern Time (“EST”) on May 5, 2009.
Drawing Eligibility. The Drawing is open to legal residents of Greensboro, North Carolina age 12 and older, who have Internet access and a valid email account as of May 5, 2009. A parent or legal guardian may complete the form using their name and e-mail address in substitution of the minor. NOTE: There are additional eligibility criteria for the drawing prizes (see details below).
To Enter. NO PURCHASE NECESSARY. Beginning at 12:01:00 a.m. EST on May 5, 2009, visit http://shield.imentorinteractive.org and follow the online application instructions for enrolling in the iMentor program. All Submissions made during that time period will be automatically entered. You must follow all online instructions for your Submission to be counted. Entrants may not enter the Drawing with multiple email addresses or under multiple identities. Any entrant who does so, or uses any device or artifice to circumvent the Official Rules may be disqualified and all of their entries forfeited.
Eligibility: To be eligible you must follow all online instructions. All Submissions will be reviewed for content and compliance with these Official Rules before being entered for the drawing.
Agreement To Official Rules. By participating in the Drawing, you fully and unconditionally agree to and accept these Official Rules and the decisions of SHIELD Mentor Program, which are final and binding.
Substitution. Prizes will be accepted as is. SHIELD Mentor Program reserves the right to substitute any prize with another prize of equal or greater value. SHIELD Mentor Program will not be obligated in any way to honor any requests by winners or contestants for substitution of prizes.
Drawing. Winners will be determined in a random drawing from all correct and valid entries under the supervision of SHIELD Mentor Program whose decisions are final. Many will enter, but only one will win!
Notification. Prize winners will be notified via the e-mail address indicated on the entry form. Winners will be required to participate in the iMentor program after notification or an alternate winner may be chosen. SHIELD Mentor Program is not responsible for any late or misdirected award notices or responses.
Publicity. Winners will be required to sign, notarize and return an Affidavit of Eligibility, Liability Release and (unless prohibited) Publicity Release within 14 days of notification or an alternate winner may be chosen. SHIELD Mentor Program is not responsible for any late or misdirected award notices or responses. Acceptance of prize constitutes permission (except where prohibited by law) to use the winner's name, likenesses, photographs, and statements made by the winner in promotions, advertisements, or on the SHIELD Mentor Program website without any compensation.
Indemnification. The applicatnt agrees to indemnify and hold SHIELD Mentor Program their agents, employees and representatives, participating retailers and/or any prize supplied harmless from and against any and all loss, cost, damage, liability and expense (including, without limitation, reasonable attorney's fees, court costs and other reasonable litigation expenses) which the contestant shall suffer, sustain or incur as a result of, arising from, or in connection with any failure of performance or any representation or warranty of the prize, any substations of prize, delay in receiving.
General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Drawing, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Drawing, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Drawing or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Drawing may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Participants, printing errors or by any of the equipment or programming associated with or utilized in the Drawing; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Drawing; (4) technical or human error which may occur in the administration of the Drawing or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant's participation in the Drawing or receipt or use or misuse of any prize. If for any reason an entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Participant's sole remedy is another entry in the Drawing, provided that if it is not possible to award another entry due to discontinuance of the Drawing, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
Disputes: Except where prohibited by law, Participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Drawing or any prize awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Drawing, but in no event attorneys' fees; and (3) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by, and construed in accordance with, the laws of the State of North Carolina without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina.
Privacy Policy: Information collected from entrants is subject to SHIELD Mentor Program's Privacy Policy and may also be used as provided for in these Official Rules.
